A French couple who have lived in Australia for more than 15 years say they are “gutted” after being told they had two weeks to leave the country.

Chef Damien Pigot and his partner Sandrine Mendy have run a cafe at Tweed Heads for the past five years, and, according to their friends, have become part of the area’s “culinary fabric”.

Mr Pigot had hoped the business would bolster his application for permanent residency.

He sought advice from migration agent Kathy Bateman about three years ago, and she was initially optimistic.

“Where there is a legally, viably operating Australian business located in a regional area that has a genuine need for an occupation … essentially there is no reason why an application shouldn’t be successful,” she said.

“[But] there has to be a benefit to Australia, and that usually means employment for Australians.

“I know that Damien made several attempts to recruit locally within the Aboriginal community as well as local schools and children to do traineeships.

“But it just didn’t work out, and anyone who is in small business knows that it’s tough.”

The couple have now been told to leave Australia by October 1.

‘They are part of the community’

Mr Pigot said he made an appeal to the Department of Home Affairs requesting ministerial intervention, but it was rejected.

“The department didn’t even refer my request to the Minister, so he didn’t get to read it, because we don’t meet the guidelines,” he said.

A spokesperson from the Department of Home Affairs said it would not comment on individual cases for privacy reasons.

It said non-citizens who did not hold a valid visa and who had exhausted all avenues to remain in Australia were expected to depart.

Mr Pigot said he could not afford to spend up to $15,000 on a visa. […]

As you may know the SC 457 visa has been abolished, as such the new TSS SC 482 visa is its replacement.

Many changes have occurred to Australian migration law during 2017 and 2018 – which has seen a major overhaul to employer sponsored pathways.

In addition to the new sub class (SC 482) the SAF – Skilling Australians Fund or NTCC – Nomination Training Contribution Charge has replaced the Training Benchmarks A and B as of 12 August 2018.  The SAF or NTCC is a fee / charge that is imposed on employers who nominate workers for temporary or permanent skilled work visas.  Depending on the turnover of the business and how many years the nomination period is for OR which sub class of visa is being nominated for will depend on how much the fee to be paid will be.

This month of March 2018 – the Department of Home Affairs (Immigration and Citizenship Services) – DOHA ICS are abolishing one of the most commonly utilised pathways. We are talking about the Temporary Work (Skilled) visa SC 457. It will be replaced by the Temporary Short Stay (TSS) visa SC 482. This Australian visa subclass has a new name and new specific requirements! The difference between visa SC 457 and SC 482 is significant. As an example, as the holder of a SC 457 you were mostly able to apply for a permanent visa. As the holder of the SC 482 you MAY not be able to. Contact us to get more information. 

As part of the changes coming in March 2018 DOHA ICS are also trying to introduce the Skilling Australians Fund (SAF).  What does this mean? Employers who wish to sponsor an overseas worker will have to pay a fee into the SAF. The intention of the SAF is to pay for training for Australians. In other words, the aim is to try to reduce our reliance on overseas workers.

The above changes on Australian visa sub classes were announced last April 2017 whereby they advised the changes were to commence in March 2018. We are all waiting with baited breath! We will share with more information as soon as know new details.

According to Australian Bureau of Statistics (ABS):

Overseas born Aussies hit a 120 year peak.

The proportion of Australians who were born overseas has hit its highest point in 120 years, with 28 per cent of Australia’s population – 6.6 million people – born overseas, according to figures released today by the Australian Bureau of Statistics (ABS).
“Australia traditionally had a high proportion of migrants, but we’ve now hit a peak not seen since the gold rushes of the late 1800s,” said Denise Carlton from the ABS.

“Overseas migration has been a large contributor to the total Australian population growth for several years – it has consistently been the main driver since 2005-06, contributing more than 50 per cent of population growth in Australia.

“While the largest migrant groups were people born in the United Kingdom and New Zealand – with a total of over 1.8 million Australian residents being born in those two countries, the next two most common birth places were from the Asian region.

“These were China and India, with around 450,000 and 400,000 people respectively.

“Of the top ten countries of birth, the number of Australian residents who were born in India increased the most, almost tripling from just 132,800 people in 2004 to 397,200 people in 2014,” said Ms Carlton.

“The number of residents born in China also more than doubled, going from 205,200 persons to 447,400 persons over those ten years.

“In contrast, the proportion of the population born in the United Kingdom saw a drop, falling from 5.6 to 5.2 per cent over the last ten years. Over the same time, New Zealand born migrants have grown from 2.1 to 2.6 per cent.”

Australia’s larger states gained the biggest share of net overseas migration, with New South Wales gaining 73,300, Victoria 59,400, Western Australia 32,300 and Queensland 30,300. Tasmania had the smallest net overseas migration gain, adding 1,300 people.
Looking at migration within Australia, net interstate migration contributed to population gains for Victoria (8,800 persons), Queensland (5,800 persons) and Western Australia (1,000 persons). Those states that experienced population loss through interstate migration were New South Wales (6,900 persons), the Northern Territory (3,300 persons), South Australia (3,000 persons) and the Australian Capital Territory and Tasmania (each 1,200 persons).

23,837,642

This projection is based on the estimated resident population at 31 December 2014 and assumes growth since then of:

one birth every 1 minute and 45 seconds,

one death every 3 minutes and 25 seconds,

a net gain of one international migration every 2 minutes and 12 seconds, leading to an overall total population increase of one person every 1 minute and 22 seconds.

These assumptions are consistent with figures released in Australian Demographic Statistics, December Quarter 2014 (cat. no. 3101.0).

From 1 July 2015 religious organisations must sign up to the ‘Minister of Religion Industry Labour Agreement’ before lodging an employer nomination for either ENS SC 186 and RSMS SC 187 – Agreement Stream and for SC 457 visa.

Applicants must meet the requirements as outlined in the ‘Minister of Religion Industry Labour Agreement’.

If an employer nomination for a Minister of Religion is lodged prior to 1 July 2015 and is subsequently approved after this date, the corresponding visa application may be lodged for the relevant stream of the Subclass 186 or Subclass 187 Visa. However, the exemptions to age, skill and English language that was available to Ministers of Religion will no longer apply.
